Terms of ticket purchase and use

1. All sales shall be final. Refunds or vouchers will be issued only on a case-by-case basis.

2. We will process a refund or voucher for future use for the full purchase value in the event that we are not able to conduct the tour. To obtain a refund, Ticket Holder will have to request a refund in writing, via email, and provide proof of purchase. We will process refunds within 30 calendar days of receipt of request.

3. No discounts or coupons apply. Seating on the shuttle is limited. We recommend purchasing in advance to secure your spot.

4. Your ticket is a revocable license. The Ticket Holder voluntarily assumes all risks and dangers incidental to travelling on the shuttle.

5. Your credit card will be charged at the time of booking. All orders are subject to credit card approval and billing address verification. The billing address will be verified with your credit card company so you must use the exact address that your statements are sent to.

6. Print-at-home ticket orders are available immediately and accessible via your confirmation email. All tickets are non-refundable/non-returnable.

Prices

Sabino Canyon Tour:  Adults and Children over two years of age: $15.00, $8:00 for Children 3-12, $8.00 *Onboarding

Bear Canyon Shuttle Route:  Adults and Children over two years of age: $8.00, $5:00 for Children 3-12, $5.00 *Onboarding

*One-way hop-on fare (down ride only) when space is available. Also, please be advised that if you “hop off” along the route, space may not be available later for a ride down. Please plan accordingly.

Transactions will be conducted in United States currency.

Additional terms and limitations

Shuttle tour times are subject to change at any time, without notice, for reasons that may include inclement weather conditions, U.S. Forest Service orders, mechanical problems and/or any other unforeseen or unscheduled events and occurrences.

Children over age 3 must have a ticket.

The following items are prohibited on our tram vehicles and tours due to security and safety restrictions: luggage, large backpacks, suitcases, briefcases, coolers, animals (other than registered service animals), carcasses, and alcohol.

Tour policies

It is the Ticket Holder’s responsibility to be at the correct pick-up time and location.  (Please be there at least 15 minutes prior to scheduled tour departure time.). Persons arriving late may forfeit their scheduled tour time.

For the comfort and safety of all passengers, we reserve the right to refuse service to passengers who are intoxicated or show signs of intoxication. If, as a result, your tour is canceled, you will not be entitled to a refund.

Tours may include some elements of risk; we assume no liability for injuries or illness. Most tours require a minimum number of passengers to operate and are subject to change without notice. Due to safety issues or weather conditions, tour dates and times may vary, and every effort will be made to re-accommodate you. A full refund will be given if a tour must be canceled by the tour operator.

Assumption of risks; limitations of liability; no warranty

Ticket Holder assumes all risks and shall hold RPC harmless for personal injury, death and property damage caused by attacks, bites or diseases by or from animals, pests or insects, sickness, extreme temperature, the lack of appropriate medical care, evacuation to same, if necessary, weather, labor strikes, disease, epidemics or the threat thereof, acts of God or government, acts of terrorism, or the threat thereof, force majeure, war, quarantine, criminal activity, defective or dangerous conditions in streets, walkways, paths, bridges, piers, or other places or facilities or any other cause beyond RPC’s control.

The Regional Partnering Center [“RPC”] is not responsible for any negligent, willful act or failure to act of any person or entity, nor for any act or inaction of any third party not under its direct control.  Without limitation, RPC is not liable for any direct, indirect, consequential, or incidental damage, injury, death, loss, accident, delay, emotional or mental distress or trauma, inconvenience or irregularity of any kind by any act or omission beyond its control, including, without limitation, any willful or negligent act or failure to act or breach of contract of any third party such as a shuttle driver or operator, travel agent or agency, airline, motor coach operator, train, boat or other provider of transportation, hotel or other lodging institution, local ground handler and/or restaurant or entertainment venue who or which is to or does supply any goods or services for your trip and tour.

In addition, RPC is not responsible for any loss, injury, death, or inconvenience due to delay, changes in schedule, overbooking of accommodation, default of any third party, attacks, bites or diseases by or from animals, pests or insects, sickness, temperature, the lack of appropriate medical care, evacuation to same, if necessary, weather, labor strikes, disease, epidemics or the threat thereof, acts of God or government, acts of terrorism, or the threat thereof, force majeure, war, quarantine, criminal activity, defective or dangerous conditions in streets, walkways, paths, piers, or other places or facilities or any other cause beyond its control. Medical services or facilities are not readily available, the evacuation to same may be time consuming and difficult and/or the competence and quality of same may not be up to the standards of services near Ticket Holder’s home. Payment to RPC constitutes unconditional acceptance of the terms and conditions set out herein.

RPC’s only liability for any claim, regardless of how presented or which theory of liability is applied, shall be limited to a refund of the ticket price.  RPC does not warrant the safety, quality or comfort of your tour.  RPC is not responsible for the integrity, value, condition, shipment or safe delivery of any purchases made during the tour.

RPC reserves the right to decline to accept or retain any person as a member of a tour at any time if, in its opinion, any such person represents a danger to him or herself or others or detracts from the enjoyment of the tour. RPC reserves the right to cancel any tour at any time and if it does so, its only liability is to refund the purchase price of the tour.  In case of computer or human billing error, RPC reserves the right to re-invoice with the correct billing. RPC is not responsible for errors on brochures, other literature, and/or its website.

Binding arbitration

Any dispute concerning, relating, or referring to your ticket or tour, the website, brochure or any other literature concerning your trip or the tour itself, shall be resolved exclusively by binding arbitration pursuant to Arizona Revised Statutes Title 12, Chapter 9, Article 1, and the then existing Commercial Rules of the American Arbitration Association (AAA) or pursuant to the Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). Such proceedings will be governed by substantive (but not procedural) Arizona law and will take place in Pima County, Arizona. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable. You (and we) waive all rights to a trial by jury.

RPC, maintains www.SabinoCanyonCrawler.com (the Site) and all of the information, data, software, photographs, logos, graphs, videos, typefaces, graphics, music, sounds, images, illustrations, designs, icons, and other materials (collectively “Content”) are for your information on tours sold by RPC. None of the Content shall be construed as an offer for the sale of any services, goods, or products of RPC or any other entity. All Content in this Site is for informational purposes only.  By using this Site, you agree to these terms.

Copyrights

You should assume that all Content on the Site is copyrighted and may not be used, except as provided in these terms or in text on the Site, without the prior written permission of RPC. Content displayed on the Site are either the property of, or used with permission by, RPC.

Trademarks

The trademarks, service mark, designs and logos (collectively, the “Trademarks”) displayed on the Site are the registered and unregistered Trademarks of RPC and others. Nothing contained on the Site should be construed as granting, by implication or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of RPC or such third party that may own the Trademarks displayed on the Site.

Additional terms of site usage

You may use or download Content displayed on this Site for non-commercial personal use. You may also use or download Content for promotion of RPC tours. You may not use or download Content for any other commercial purpose without RPC’s written permission. RPC has not reviewed all the sites linked to this Site and is not responsible for the content of any linked sites or any link contained in a site or any changes or updates to such sites (collectively “Linked Sites”). RPC does not endorse or make any representations regarding any Linked Sites. Your linking to any Linked Sites is at your own risk. RPC also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of Content from the Site. RPC may at any time modify these Terms of Site Usage and your continued use of the Site will be conditioned upon the Terms of Site Usage in force at the time of your use.

Comments, feedback and other submissions

Operations policy

Ticket purchases

Shuttle tickets may be purchased in advance on this website or on site at the various payment kiosks, the ticket booth drop box, or at the Sabino Canyon Recreation Area Visitor Center gift shop.  Tickets for walk-up visitors, if available, will be sold on first-come, first-served basis. All purchases are subject to the ticket terms and use agreement.

U.S. Forest Service recreational/parking fee

Tickets for the shuttle do not include the required U.S. Forest Service’s Recreational Fee for vehicles entering the parking lot. The recreational fee may be paid at the Sabino Canyon Recreational Area parking lot ticket booth or by using one of the recreation area’s drop boxes.

Forms of payment

Acceptable forms of payment are cash, check, and credit cards.  The website, kiosks, and gift shop accept credit cards but cash and checks are only accepted via the ticket booth drop box (exact cash only) or the Sabino Canyon Recreation Area Visitor Center gift shop.

Proof of purchase

Sabino Canyon Crawler will accept electronic and printed copy of receipt as proof of purchase.  No one will be allowed to board the shuttle without proof of purchase. Children under the age of two ride free.  However, said children are still subject the ticket terms and use agreement and must safely sit on the lap of an accompanying adult.

Shuttle departure/late arrivals

Shuttles will depart promptly at the designated times.  Visitors should arrive and check in with the concierge at least fifteen (15) minutes prior to scheduled departure time.  Persons arriving late may forfeit their scheduled tour time.

Riding the shuttle

For the safety of all passengers, the following regulations apply:

  • Passengers must be seated at all times while the shuttle is moving
  • Keep arms, legs and hands inside the vehicle at all times
  • No pets allowed, except for bona fide service animals as defined in Title II of the Americans with Disabilities Act
  • No food or drink is allowed on the shuttle except for water and baby care items
  • All passengers ride at their own risk.
  • Shuttle drivers reserve the right to dismiss unruly passengers and/or those violating any regulations

This privacy notice discloses the privacy practices for this website.  This privacy notice applies solely to information collected by this website.  It will notify you of the following:

  1. What personally identifiable information is collected from you through the website, how it is used, and with whom it may be shared.
  2. What choices are available to you regarding the use of your data.
  3. The security procedures in place to protect the misuse of your information.

Information collection, use, and sharing
We are the sole owners of the information collected on this site.  We only have access to/collect information that you voluntarily give us via email or other direct contact from you.  We will not sell or rent this information to anyone.  We will use your information to respond to you, regarding the reason you contacted us.  We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. to ship an order.  Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.

We may share aggregated demographic information with our partners and advertisers.  This is not linked to any personal information that can identify any individual person.  We use a credit card processing company to bill users for services.  These companies do not retain, share, store or use personally identifiable information for any secondary purposes beyond filling your order.

We partner with other parties to provide specific services.  When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services.  These parties are not allowed to use personally identifiable information except for the purpose of providing these services.

Surveys & contests
From time-to-time our site may request information via surveys or contests.  Participation in these surveys or contests is completely voluntary and you may choose whether or not to participate and therefore disclose this information.  Information requested may include contact information (such as name and mailing address), and demographic information (such as ZIP code, age level).  Contact information will be used to notify the winners and award prizes.  Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site.

Orders
We request information from you on our order form.  To buy from us, you must provide contact information (like name and mailing address) and financial information (like credit card number, expiration date).  This information is used for billing purposes and to fill your orders.  We may use this information to contact you.
